Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Nextproptrader LLC ("Company," "we," "our," or "us") regarding your use of our trading platform, services, and website.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Eligibility and Account Requirements

Age and Legal Capacity

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using our services under applicable law
  • Provide accurate and complete information during registration

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains current and accurate

Trading Services and Evaluation Program

HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, SOME OF WHICH ARE DESCRIBED BELOW. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN; IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED BY ANY PARTICULAR TRADING PROGRAM. ONE OF THE LIMITATIONS OF HYPOTHETICAL PERFORMANCE RESULTS IS THAT THEY ARE GENERALLY PREPARED WITH THE BENEFIT OF HINDSIGHT. IN ADDITION, HYPOTHETICAL TRADING DOES NOT INVOLVE FINANCIAL RISK, AND NO HYPOTHETICAL TRADING RECORD CAN COMPLETELY ACCOUNT FOR THE IMPACT OF FINANCIAL RISK OF ACTUAL TRADING. FOR EXAMPLE, THE ABILITY TO WITHSTAND LOSSES OR TO ADHERE TO A PARTICULAR TRADING PROGRAM IN SPITE OF TRADING LOSSES ARE MATERIAL POINTS WHICH CAN ALSO ADVERSELY AFFECT ACTUAL TRADING RESULTS. THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM WHICH CANNOT BE FULLY ACCOUNTED FOR IN THE PREPARATION OF HYPOTHETICAL PERFORMANCE RESULTS AND ALL WHICH CAN ADVERSELY AFFECT TRADING RESULTS.

Educational and Entertainment Services

Company engages in general trader education and training and providing entertainment services. The intent of Company is to identify individuals with a talent for trading. No trading signals or live trading is provided directly by Nextproptrader.

Our services are designed for educational purposes and entertainment value, helping traders develop and demonstrate their skills in a controlled, simulated environment.

Evaluation Process

Our evaluation program involves:

  • Simulated trading environment with virtual capital
  • Performance assessment based on predefined criteria
  • Risk management requirements and drawdown limits
  • Minimum trading days and profit targets

Funded Accounts

Upon successful evaluation completion, you may receive access to a funded trading account. However, it is important to understand that this "funded account" is also a simulated trading environment and not a real capitalized account. At no time does the trader receive access to actual capital, as providing real funded accounts would be illegal or require licensing in most jurisdictions.

  • Access to simulated "funded" trading environment
  • Profit sharing arrangements as specified in your agreement
  • All trading remains in simulated environment
  • No actual capital is provided to traders
  • Regular performance monitoring and review

Payment Terms and Refund Policy

No Refund Policy

ALL SALES ARE FINAL. There are no refunds, returns, or money-back guarantees for any payments made for evaluations, subscriptions, or any other products or services offered by Nextproptrader LLC.

This policy exists because our services are delivered immediately upon purchase. Once you gain access to our trading platform, evaluation programs, or educational materials, the service has been fully provided and cannot be returned.

Payment Terms

  • All fees must be paid in full before accessing services
  • Payments are processed immediately and services are activated instantly
  • You are responsible for all applicable taxes and fees
  • Failed payments may result in immediate service suspension
  • Chargebacks or payment disputes may result in permanent account termination

Risk Disclosure and Warnings

Important Risk Warning

Trading in financial markets involves substantial risk of loss and is not suitable for all investors. Past performance does not guarantee future results. You should carefully consider whether trading is appropriate for you in light of your experience, objectives, financial resources, and circumstances.

  • Market volatility and price fluctuations
  • Leverage amplifying both gains and losses
  • Liquidity risks in certain market conditions
  • Technology and system failures
  • Regulatory and political risks
  • Currency exchange rate fluctuations

Prohibited Activities and Conduct

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Engage in market manipulation or fraudulent trading practices
  • Attempt to circumvent our risk management systems
  • Share account credentials or allow unauthorized access
  • Use automated trading systems without prior approval
  • Engage in arbitrage or latency exploitation strategies
  • Violate any applicable laws, regulations, or exchange rules
  • Interfere with the proper functioning of our platform

Intellectual Property Rights

All content, features, and functionality of our platform, including but not limited to text, graphics, logos, software, and design, are owned by Nextproptrader LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We implement appropriate security measures to protect your data, but cannot guarantee absolute security.

Optional address suggestions include Google Maps features and content. Their use is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

Limitation of Liability and Disclaimers

NEXTPROPTRADER LLC ASSUMES NO LIABILITY FOR ANY LOSSES, DAMAGES, OR EXPENSES that may arise from your use of our services, including but not limited to:

  • Simulated Trading losses or missed profit opportunities
  • Technical failures or platform downtime
  • Data inaccuracies or delayed market information
  • Evaluation failures or account terminations
  • Any direct, indirect, incidental, or consequential damages

You acknowledge that you use our services entirely at your own risk and that we shall not be held responsible for any financial losses or other damages you may incur.

Service Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind. We disclaim:

  • Warranties of merchantability and fitness for a particular purpose
  • Guarantees of uninterrupted or error-free service
  • Accuracy or completeness of market data or information
  • Investment advice or recommendations

Liability Limitations

To the maximum extent permitted by law, Nextproptrader LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Termination and Suspension

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our policies
  • Fraudulent or suspicious activity
  • Failure to meet evaluation or performance requirements
  • Legal or regulatory requirements

Upon termination, your right to use our services will cease immediately, and we may delete your account and data in accordance with our data retention policies.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

Before pursuing formal legal action, we encourage you to contact us directly to resolve any disputes. We are committed to working with you to find a fair and reasonable solution.

Changes to Terms of Service

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of our services after such changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of our services.
